Imagehost-4u.com does not knowingly host any unlawful, harmful, threatening, abusive, illegal, copyright infringing, harassing, tortuous, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, hateful, or racially, ethnically or otherwise objectionable; harm minors in any way; impersonate any person or entity, content. We take strong action against piracy and do not tolerate it.

3. unauthorized access to or alteration of your transmissions or data;

5. any other matter relating to the website’s service.

In no event shall imagehost-4u.com’s total liability to you for all damages, losses, and causes of action whether in contract, tort (including, but not limited to, negligence), or otherwise exceed the amount paid by you, if any, for accessing this site.

INDEMNIFICATION

You are entirely responsible for maintaining the confidentiality of your password and account. Furthermore, you are entirely responsible for any and all activities which occur under your ip. You agree to indemnify, defend and hold harmless imagehost-4u.com and its officers, directors, employees, consultants and agents from any and all third party claims, liability, damages and/or costs (including, but not limited to, attorneys fees) arising from your use of the website’s service, your violation of the terms of use or your infringement, or infringement by any other user of your account, of any intellectual property or other right of any person or entity. you agree to immediately notify imagehost-4u.com of any unauthorized use of your ip or any other breach of security known to you. Also, your account is not transferable in any way. You may never trade your login details nor knowingly allow others to use you account. If you think your account is used by someone else as well, report it as soon as possible.

OTHER

By uploading any file with any extension, you agree that imagehost-4u.com may remove, delete, hence to host, serve, make available, your file(s). You also agree that imagehost-4u.com does not have to supply any reason to you or anyone else as to why your file(s) were removed. We reserve the right to delete any file, at any time, for any reason. “unlimited downloads” refers to our processor and bandwidth limits. We make necessary upgrades from time to time, but on some occasions your files may be removed due to excessive bandwidth, excessive cpu, not likely but possible. We have no unlimited resources. All files, speed, etc, are hosted on a “best effort” basis. We do not make any guarantees, whether express or implied other than set in this document. Also, no image shall use more than 1% of our total monthly transfer rate. This is monitored and applied by IH4U_BOT, an automated robot. If the image uses more than 1% of our total monthly transfer rate, your image will be removed without notice. You may recover your image by messaging us the link to the image which was removed or its unique ID. We will send you the image in an e-mail, as an attachement.

The refund policy is:
Rufund due to downtime:
Imagehost-4u.com will refund your account only if, in a given month, we couldn’t maintain a 98% uptime (roughly 14 hours of downtime in a month).
One free day, or 10 gigabyte of transfer depending on what plan you signed up for, per 7 hours of downtime.
The service uptime is monitored by InternetSeer.com and every month the uptime is made public.
The refund is made by an automatic system which will scan your account details if the uptime was below 98%, if the system fails to do it, please report it as soon as possible.
Trial period:
The overwhelming majority of people that use our service are satisfied with it, and at the time of writing we didn’t have to refund anybody.
If you have used less than 1 GB of bandwidth, and email us to cancel your account within 7 days of the transaction date, we will refund you in full. We urge you to use this period to test our services capabilities and suitability for you.
Before the 20th (inclusuve) day of each month we refund you within 6 hours. After that day and 1st of next month, we refund you within 10 days after your refund inquiry.
If you used more than 1 GigaByte of bandwidth and/or your account is more than 7 days old, no refund is possible.

Affiliation policy: We are not affiliated in any way with the third parties who our developer(s) linked to if the domain the link points to is not hosted by one of our servers. We have absolutely no control whatsoever over the content what you may see on these third-party websites, the fact we link to these websites is just a matter of coincidence and it does not mean we accept or agree with their content and/or policies in any way.

Massaging Policy: We do not tolerate SPAM and we do not want Spammers period. No user shall use our messaging relays for sending unsolicited messages, widely known as Spam.
The current messaging features are: SMS and MMS sending, E-card and E-mail sending. Not obeying this rule will draw immediate account termination without the possibility of any refund what-so-ever.

If you want to send mass-messages, please contact us before doing so.

Account termination policy: Imagehost-4u.com reserves the right to terminate your account without any notice if we find you did not obey the rules set IAW this document.
You may ask us to provide you the files you uploaded to our servers for a fee of $10 (USD).

imagehost-4u.com also reserves the right to change, modify, or add to this (terms of service) without any notification to anyone. please check this regularly. imagehost-4u.com is not responsible for any content uploaded.

Contests Rules and Policy

Any contest is open to anyone where Amazon.com’s or PayPal.com’s service is available and is 18 years of age and older.
Contests are not open to employees and representatives of Imagehost-4u.com, including its subsidiaries, sponsors, advertising and promotional agencies and members of the immediate families of such employees or representatives and persons with whom such employees and representatives are domiciled. For the purpose of the Contests, “immediate family” is defined as parent, sibling, child or any person residing in the same household as, or domiciled with, any such employees or representatives.

The Contest is also not open to entrants who may have won previous contests entered on Imagehost-4u in the last thirty (60) days.

Any selected entrant who cannot be contacted or who fails to respond to any telephone message or email within five (5) days of the first attempt to contact such selected entrant may, at the sole discretion of the Contest judges, be declared ineligible and the Contest judges reserve the right, in such event, in their sole discretion, to select at random one or more additional entrants whom they shall attempt to contact, and who shall be subject to disqualification, in the same manner.

All entries become the property of the Contest Sponsor and none will be returned.

Before being awarded a prize, the winner may also be required to sign a declaration and release form stating that he/she has read, understood and complied with these Contest Rules, grants all consents required as contemplated in these Contest Rules, authorizes the Imagehost-4u.com to broadcast, publish and disseminate his/her username, in connection with any promotion or publicity, and/or for general news, entertainment and information purposes at no compensation to the selected entrant, accepts the prize as offered and releases the organizator from any and all liability of any kind arising out of the selected entrant’s participation in Contests and receipt and use of the prize.

The odds of winning a prize depends on the number of eligible entries received.

Important Notes:

1. If there is more than one entry per person per day, double entries will be accepted by the system but rejected for the draw. The use of more than one account per person constitutes fraud.
2. The winners’ names may be posted on the site.
3. The winners’ names will be posted on the site only once the winners have been contacted and they have accepted their prize.

GENERAL CONDITIONS:

Imagehost-4u.com extends absolutely no representations or warranties in respect of any prizes and accepts no liability arising in respect of such prizes. Prizes must be accepted as awarded with no substitutions, provided that the organizator shall have the right, at its sole discretion and for any reason, to substitute a prize or prizes of equal or greater monetary value. Prizes are non-transferable and not redeemable for cash.

If for any reason in the opinion of the organiztor, in its sole discretion, the Contest is not capable of running as planned or if the administration, security, fairness, integrity, or proper conduct of the Contest is corrupted or adversely affected, including by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond its control, Imagehost-4u.com reserves the right to cancel, terminate, modify or suspend the Contest including cancelling any method of entry, and selecting a winner from previously received eligible entries.

Imagehost-4u.com will not be responsible for telephone, technical, network, online, electronic, computer hardware or software failures of any kind, misdirected, stolen, incomplete, garbled or delayed Internet/e-mail computer transmissions on account of technical problems or traffic congestion on the Internet or at any Web site, or any combination thereof, including any injury or damage to participant’s or any other person’s computer relating to or resulting from participation or downloading any materials in this Contest.

Imagehost-4u.com reserves the right, in its sole discretion, to disqualify any individual they find to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Contest Rules or otherwise in a disruptive manner. Imagehost-4u.com reserves the right to modify the Contest Rules without materially affecting the terms and conditions of the Contest.

These Contest Rules govern all aspects of the Contest and are binding on all participants.

Online entries will be deemed to have been submitted by the authorized account holder of the email address submitted at the time of entry. “Authorized account holder” is defined as the natural person who is assigned to an email address by an internet access provider, online service provider, or other organization (e.g. business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.
